Distance Sales Agreement & Refund Policy

1. Parties
SELLER: Umut Seyarcı, sole proprietor, Küçükyalı Vergi Dairesi Müdürlüğü, Tax ID: 7660970931. Registered address: Altıntepe Mah. Özçiçek Sk. Elif Apt. No:3/1, 34840 Maltepe/İstanbul, Türkiye. Contact: info@pitchko.io · +90 545 369 61 67. Trade name: Pitchko, providing the Service at pitchko.io. BUYER: The natural or legal person who creates a Pitchko account and purchases the Service. The Buyer represents that the information provided during sign-up is accurate.
2. Subject of the agreement
This Distance Sales Agreement governs the conditions of delivery, fees, payment, termination and refund for the digital content service ("Service") the Buyer purchases through the Pitchko platform. Turkish Consumer Protection Law No. 6502 and the Distance Sales Regulation apply.
3. Service and pricing
Three plans are available: (a) Trial Pack — $19 (one-time). 1 pitch deck included; additional decks $19 each. (b) Pro Subscription — $39/mo or $29/mo billed yearly. 5 pitch decks included per month; unused decks roll over up to 10; additional decks $9 each. (c) Enterprise — custom volume and pricing set in a separate contract. All prices are in US Dollars (USD). Displayed prices are VAT-inclusive for domestic (TR) customers (20% VAT); for export (non-TR) sales the price is the net amount with 0% Turkish VAT (service export, VAT Law Art. 11/1-a). Payments are processed via iyzico in TRY, USD, EUR, GBP, RUB, CHF or NOK.
4. Delivery method and timing
The Service is delivered digitally and immediately. Upon payment confirmation, the Buyer's Pitchko account is activated and the plan quota becomes immediately usable. There is no separate physical delivery; the place of delivery is the Buyer's account.
5. Monthly and yearly renewal
The Pro Subscription auto-renews. Unless cancelled by the Buyer at least 24 hours before the renewal date, the next period's fee is charged to the saved payment method. Cancellation is one click from Settings → Billing; it takes effect at the end of the current period, and the existing quota remains usable until then.
6. Right of withdrawal
Under Turkish Distance Sales Regulation Art. 15(ğ), the right of withdrawal for digital content delivered electronically and instantly lapses once performance begins with the Buyer's express consent. IN PRACTICE: (i) If no pitch deck has yet been generated, you may exercise the right of withdrawal within 14 days of purchase. (ii) Once any pitch deck generation begins, the right of withdrawal lapses. For B2B contracts (legal entity buyers), consumer law does not apply; refund terms are governed by the master agreement signed with your organization.
7. Refund process
Refund requests are sent in writing to info@pitchko.io from the email address associated with your account. The request must include the order date, the payment method used, and the reason. Approved refunds are returned within 14 business days to the same payment method used at purchase. For iyzico-processed payments, the refund may take 1-7 business days to reach the Buyer's bank account depending on bank processing times. Partial-period subscription refunds for unused days are not standard; pro-rata refunds are issued only when service interruption is caused by Pitchko (permanent access loss, service shutdown).
8. Cancellation and account termination
Cancel your subscription anytime from Settings → Billing. To delete your account entirely, go to Settings → Account → Delete my account. Under KVKK, your personal data is deleted or anonymised within 30 days of an account deletion request; data subject to legal retention obligations (e.g. invoice records) is kept for the duration required by the applicable regulation.
9. Dispute resolution and competent court
This agreement is governed by the laws of the Republic of Turkey. Buyers acting as consumers may, within the monetary thresholds set yearly by the Turkish Ministry of Trade, apply to the Consumer Arbitration Committee, and beyond those thresholds, to the Consumer Court at their residence or at the Seller's place of business. For non-consumer buyers, the Istanbul Anatolian Courts and Enforcement Offices have exclusive jurisdiction.
